Kullanım Şartları

Bu Kullanım Şartları ("Şartlar"), mithot.dev ("biz", "stüdyo") tarafından sunulan web sitesi, mobil uygulamalar, API'ler ve ilgili tüm dijital hizmetlerin ("Hizmetler") kullanımını düzenler.

Hizmetlere erişerek veya bunları kullanarak bu Şartları okuduğunuzu, anladığınızı ve bunlarla bağlı olmayı kabul ettiğinizi beyan edersiniz. Şartların herhangi bir maddesini kabul etmiyorsanız Hizmetleri kullanmamalısınız.

These Terms of Service ("Terms") govern the use of the website, mobile applications, APIs and all related digital services ("Services") provided by mithot.dev ("we", "the studio").

By accessing or using the Services you confirm that you have read, understood and agree to be bound by these Terms. If you do not accept any part of them, you must not use the Services.

mithot.dev; mobil uygulamalar, web uygulamaları, API'ler ve otomasyon araçları geliştiren bağımsız bir yazılım stüdyosudur. Hizmetler, önceden bildirimde bulunularak veya teknik zorunluluk hâlinde bildirimsiz olarak değiştirilebilir, geçici olarak durdurulabilir ya da sonlandırılabilir.

Kesintisiz veya hatasız bir hizmet taahhüdü verilmez; bakım, güncelleme ve altyapı kaynaklı kesintiler yaşanabilir.

mithot.dev is an independent software studio that builds mobile applications, web applications, APIs and automation tools. The Services may be modified, suspended or discontinued — with prior notice where practical, or without notice where technically necessary.

We make no commitment of uninterrupted or error-free service; downtime may occur due to maintenance, updates or infrastructure issues.

Bu Şartlara uymanız kaydıyla, Hizmetleri kişisel veya iç kurumsal amaçlarla kullanmanız için size sınırlı, münhasır olmayan, devredilemez ve geri alınabilir bir lisans verilir.

Bu lisans; Hizmetlerin satılması, kiralanması, alt lisanslanması veya ticari olarak yeniden dağıtılması hakkını içermez.

Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable and revocable licence to use the Services for personal or internal business purposes.

This licence does not include the right to sell, rent, sub-license or commercially redistribute the Services.

Hizmetleri kullanırken aşağıdakileri yapmamayı kabul edersiniz:

• Yürürlükteki mevzuata veya üçüncü kişilerin haklarına aykırı davranmak.
• Kaynak kodu tersine mühendislikle çözmek, kaynak koda dönüştürmek veya izinsiz türev çalışma üretmek.
• Güvenlik önlemlerini aşmaya çalışmak, yetkisiz erişim sağlamak veya sistemleri taramak.
• Otomatik araçlarla aşırı istek göndererek altyapıya orantısız yük bindirmek.
• Zararlı yazılım, virüs veya kötü amaçlı kod yaymak.
• Başka bir kişi veya kurum adına hareket ediyormuş gibi göstermek.
• Hizmetleri spam, dolandırıcılık veya yanıltıcı içerik dağıtımı için kullanmak.

When using the Services you agree not to:

• Act in breach of applicable law or the rights of third parties.
• Reverse-engineer, decompile or create unauthorised derivative works of the software.
• Attempt to bypass security measures, gain unauthorised access or scan our systems.
• Place a disproportionate load on the infrastructure through automated or excessive requests.
• Distribute malware, viruses or other malicious code.
• Impersonate another person or organisation.
• Use the Services for spam, fraud or the distribution of misleading content.

Bazı Hizmetler hesap oluşturmayı gerektirebilir. Hesap bilgilerinizin doğru ve güncel olmasından, giriş bilgilerinizin gizliliğinden ve hesabınız üzerinden gerçekleştirilen tüm işlemlerden siz sorumlusunuz.

Yetkisiz bir erişim fark ettiğinizde gecikmeksizin bizimle iletişime geçmelisiniz.

Some Services may require an account. You are responsible for keeping your account details accurate and up to date, for the confidentiality of your credentials, and for all activity carried out through your account.

You must contact us without delay if you become aware of any unauthorised access.

Hizmetlere ait tüm kaynak kodu, tasarım, arayüz, metin, grafik, logo ve marka unsurları mithot.dev'e aittir ve fikri mülkiyet mevzuatı ile korunmaktadır.

Açıkça izin verilmedikçe bu unsurları kopyalayamaz, değiştiremez, dağıtamaz veya ticari amaçla kullanamazsınız. Hizmetler üzerinden içerik yüklüyorsanız, o içeriğe ilişkin haklar sizde kalır; yalnızca hizmeti sunabilmemiz için gerekli sınırlı kullanım hakkını bize vermiş olursunuz.

All source code, design, interfaces, text, graphics, logos and brand elements of the Services belong to mithot.dev and are protected by intellectual property law.

You may not copy, modify, distribute or commercially exploit these elements unless expressly permitted. If you upload content through the Services, you retain the rights to it and grant us only the limited licence needed to operate the service.

Hizmetler, üçüncü taraflara ait sitelere bağlantı içerebilir veya üçüncü taraf servisleri (ör. Google Play, Firebase) kullanabilir. Bu tarafların içerik, politika ve uygulamalarından sorumlu değiliz. İlgili tarafların kendi şart ve gizlilik politikalarını incelemeniz gerekir.

The Services may link to third-party websites or rely on third-party services (for example Google Play or Firebase). We are not responsible for their content, policies or practices, and you should review their own terms and privacy policies.

Hizmetlerin bir bölümü ücretsizdir. Ücretli uygulama, abonelik veya uygulama içi satın alma söz konusu olduğunda, ödeme ve iade işlemleri ilgili mağazanın (Apple App Store veya Google Play) kural ve prosedürlerine tabidir. Ödeme bilgilerinize erişimimiz yoktur.

Fiyatlar önceden bildirimde bulunularak değiştirilebilir; değişiklikler mevcut abonelik döneminizi etkilemez.

Part of the Services is free of charge. Where a paid application, subscription or in-app purchase applies, payment and refund handling is subject to the rules and procedures of the relevant store (Apple App Store or Google Play). We have no access to your payment details.

Prices may change with prior notice; changes do not affect your current subscription period.

Hizmetler "olduğu gibi" ve "mevcut hâliyle" sunulmaktadır. Yürürlükteki hukukun izin verdiği azami ölçüde; belirli bir amaca uygunluk, ticarete elverişlilik, kesintisizlik veya hatasızlık dâhil olmak üzere açık ya da zımni hiçbir garanti verilmemektedir.

Hizmetlerin kullanımından doğan risk tamamen size aittir.

The Services are provided "as is" and "as available". To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, uninterrupted operation and freedom from errors.

You use the Services entirely at your own risk.

Yürürlükteki hukukun izin verdiği ölçüde mithot.dev; kâr kaybı, veri kaybı, iş kesintisi veya itibar zararı gibi dolaylı, arızi, özel ya da cezai nitelikteki zararlardan sorumlu tutulamaz.

Her hâlükârda toplam sorumluluğumuz, talebe konu olaydan önceki on iki (12) ay içinde ilgili Hizmet için bize ödediğiniz tutarla sınırlıdır; ücretsiz hizmetlerde bu tutar sıfırdır.

To the extent permitted by applicable law, mithot.dev shall not be liable for indirect, incidental, special or punitive damages, including loss of profit, loss of data, business interruption or reputational harm.

In any case our total liability is limited to the amount you paid us for the relevant Service in the twelve (12) months preceding the event giving rise to the claim; for free services that amount is zero.

Bu Şartları ihlal etmeniz hâlinde erişiminizi bildirimde bulunmaksızın askıya alabilir veya sonlandırabiliriz. Siz de dilediğiniz zaman uygulamaları kaldırarak ve Hizmetleri kullanmayı bırakarak bu sözleşmeyi sonlandırabilirsiniz.

Fesihten sonra fikri mülkiyet, garanti reddi ve sorumluluk sınırlarına ilişkin hükümler yürürlükte kalmaya devam eder.

We may suspend or terminate your access without notice if you breach these Terms. You may end this agreement at any time by uninstalling the applications and ceasing to use the Services.

Provisions on intellectual property, disclaimers and limitation of liability survive termination.

Bu Şartlar Türkiye Cumhuriyeti hukukuna tabidir ve bu hukuka göre yorumlanır. Şartlardan doğan uyuşmazlıklarda Türkiye Cumhuriyeti mahkemeleri ve icra daireleri yetkilidir. Tüketici sıfatıyla sahip olduğunuz zorunlu yasal haklar bu hükümden etkilenmez.

These Terms are governed by and construed in accordance with the laws of the Republic of Türkiye. The courts and enforcement offices of the Republic of Türkiye have jurisdiction over disputes arising from them. Your mandatory statutory rights as a consumer are not affected by this clause.

Bu Şartlar zaman zaman güncellenebilir. Güncel sürüm her zaman bu sayfada yayımlanır ve "Son güncelleme" tarihi yenilenir. Değişiklikten sonra Hizmetleri kullanmaya devam etmeniz, güncel Şartları kabul ettiğiniz anlamına gelir.

These Terms may be updated from time to time. The current version is always published on this page and the "Last updated" date is revised. Continuing to use the Services after a change means you accept the updated Terms.
